Understanding Bankruptcy Types
There are two types of consumer bankruptcy: Chapter 7 and Chapter 13. Chapter 7, often referred to as liquidation or straight bankruptcy, allows for the discharge of unsecured debts while permitting the debtor to exempt certain assets, such as their home, car, and bank accounts. The debtor must pass the means test to qualify. Chapter 13, known as reorganization, involves restructuring debts so that the debtor can repay creditors over three to five years using future income. This option also requires passing the Means Test and participation in credit counseling and debtor education courses.
