Consumer Bankruptcy is a “fresh start” federal protection afforded to everyone with overwhelming debt. For individuals, who are receiving calls from creditors, lawsuits filed against them, wage garnishments, and (sometimes) foreclosure or repossession actions, bankruptcy protection will eliminate those debts entirely or allow a payment plan in which the entire debt or just a portion is paid to the creditor.
Estate Planning is the process of drafting legal documents that specifically state what happens to your money, property, and responsibilities if you die or become unable to make decisions for yourself. Estate Planning allows you to stay in control of your assets, even when you pass away or not able to speak for yourself.
Elder Law is a legal field focused on issues that commonly affect older adults and their families. It’s a mix of planning, protection, and problem-solving as people age. Elder Law typically covers planning for long term care, obtaining Medicaid, estate planning, guardianship, conservatorship, elder abuse and neglect, retirement benefits, and housing issues. The people needing elder law information and assistance are older adults planning for the future, adult children caring for aging parents, families facing nursing home costs, and anyone worried about protecting assets while qualifying for benefits
Probate is the legal process of distributing a deceased person’s assets and paying that person’s debts. The probate process can be confusing for those individuals not familiar with the process. Probate is required if a person dies with or without a will.
Trust Administration is a private legal process whereby a trustee (a chosen individual) ensures that a trust drafted and signed by a person (Grantor) is managed and run legally, fairly and according to the terms of the trust document. Trust Administration includes managing trust assets, keeping records, accounting for income and expenditures, paying debts and taxes, distributing assets, and communicating with beneficiaries.
Special Education Law is a set of rules that make sure students with disabilities have access to free appropriate public education (FAPE) that meets their individual needs, just like other students, but with the right supports. Special education law protects the rights of students with disabilities, requires schools to identify, evaluate, and support those students, and ensures education is accessible and fair to every child.
